Il doit ainsi prendre les mesures techniquement r\u00e9alisables et adapt\u00e9es \u00e0 l\u2019entreprise pour arriver \u00e0 cette fin.<\/p><p>La loi f\u00e9d\u00e9rale r\u00e9git le tabagisme passif dans les locaux ferm\u00e9s accueillant du public ainsi que dans les espaces de travail partag\u00e9s par plusieurs personnes. Ne sont donc pas concern\u00e9s les bureaux individuels ainsi que les habitations priv\u00e9es. Cette loi fixe un cadre qui s\u2019applique \u00e0 l\u2019ensemble du territoire suisse (loi f\u00e9d\u00e9rale) mais laisse la possibilit\u00e9 aux cantons d\u2019\u00e9dicter des r\u00e8gles plus strictes. C\u2019est le cas pour le canton de Vaud via la loi sur l\u2019interdiction du fumer dans les lieux publics (LIFLP).<\/p><ol start=\"2\"><li>Exceptions<\/li><\/ol><p>Les deux lois, f\u00e9d\u00e9rales et cantonales, permettent des exceptions au cadre g\u00e9n\u00e9ral.<\/p><p>La loi f\u00e9d\u00e9rale autorise les employeurs \u00e0 pr\u00e9voir des locaux fumeurs s\u2019ils sont identifi\u00e9s comme tels, que personne n\u2019y travaille, ventil\u00e9s et herm\u00e9tiquement s\u00e9par\u00e9s des bureaux non-fumeurs.<\/p><p>La loi f\u00e9d\u00e9rale autorise \u00e9galement les restaurants et bars fumeurs avec autorisation pr\u00e9alable. La loi cantonale n\u2019autorise pas les restaurants et bars fumeurs. Elle pr\u00e9voit en revanche sous conditions la possibilit\u00e9 pour ces \u00e9tablissements de se munir d\u2019un fumoir.<\/p><ol start=\"3\"><li>Sanctions<\/li><\/ol><p>Elles peuvent aller d\u2019une amende de 1\u2019000.- CHF \u00e0 la fermeture administrative de l\u2019\u00e9tablissement contrevenant intentionnellement ou par n\u00e9gligence les lois sur l\u2019interdiction de fumer.<\/p><ol start=\"4\"><li>Cigarette \u00e9lectronique<\/li><\/ol><p>Ce cas n\u2019est pas couvert par la loi et n\u2019a pas encore \u00e9t\u00e9 tranch\u00e9 par la jurisprudence. L\u2019employeur est donc libre d\u2019\u00e9dicter ses propres r\u00e8gles sur cette pratique au sein de son entreprise.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>At the canton of Vaud level, two laws regulate smoking in the workplace: the federal law on passive smoking and its ordinance, and the Vaud law on smoking bans in public places.<\/p>\n<p>Protection of workers in general<br \/>\nEvery employer must protect the health of their employees.
