A ce sujet, la jurisprudence admet que le contrat de travail soit r\u00e9sili\u00e9, ceci m\u00eame avant l\u2019entr\u00e9e en fonction.<\/p><p><br \/><strong>1. R\u00e9siliation par le salari\u00e9<\/strong><\/p><p><br \/>Dans ce cas, le travailleur sera tenu de se pr\u00e9senter au travail pendant 7 jours, sauf si l\u2019employeur y renonce.<br \/>S\u2019il ne se pr\u00e9sente pas, l\u2019employ\u00e9 s\u2019expose aux dispositions l\u00e9gales relatives \u00e0 l\u2019abandon de poste qui pr\u00e9voit le versement \u00e0 l\u2019entreprise d\u2019une indemnit\u00e9 \u00e9gale \u00e0 25% du salaire mensuel plus potentiels dommages et int\u00e9r\u00eats.<\/p><p><br \/><strong>2. R\u00e9siliation par l\u2019employeur<\/strong><\/p><p><br \/>Dans ce cas, l\u2019employeur devra verser l\u2019\u00e9quivalent de 7 jours de salaire \u2013 potentiellement plus si l\u2019employ\u00e9 peut justifier d\u2019un dommage.<br \/>Le salari\u00e9 n\u2019aura pas \u00e0 se pr\u00e9senter au travail. Par ailleurs, il ne b\u00e9n\u00e9ficie d\u2019aucune protection relative au licenciement \u00e9tant consid\u00e9r\u00e9 comme en p\u00e9riode d\u2019essai (pas de suspension en cas de maladie par exemple).<\/p><p><br \/><strong>3.
