Ceci para\u00eet d\u2019autant plus important que cette question n\u2019a pas encore \u00e9t\u00e9 tranch\u00e9e par les tribunaux suisses. Toutefois, on peut pr\u00e9ciser ci-dessous certains comportements \u00e0 adopter.<br \/><br \/>1. Devoirs de l\u2019employeur<\/p><ul><li>Les r\u00e9seaux professionnels (LinkedIn, Viadeo, etc.) rentrent dans le champ de l\u2019activit\u00e9 professionnelle et devraient pouvoir \u00eatre utilis\u00e9s.<\/li><li>Les r\u00e9seaux priv\u00e9s (Facebook par exemple) rel\u00e8vent de la sph\u00e8re personnelle de l\u2019employ\u00e9. Ceci est notamment le cas lorsque des opinions politiques ou religieuses sont partag\u00e9es. Ainsi, l\u2019employeur ne pourra r\u00e9colter ces donn\u00e9es qu\u2019avec l\u2019accord du salari\u00e9 et uniquement s\u2019il existe un motif justificatif et un soup\u00e7on d\u2019infraction grave.<\/li><\/ul><p>2. Devoirs du salari\u00e9<br \/><br \/>Les principaux devoirs du salari\u00e9 en ce qui concerne l\u2019utilisation des r\u00e9seaux sociaux sont au nombre de 3. Ainsi, l\u2019employ\u00e9 :<\/p><ul><li>Ne doit pas d\u00e9nigrer sa soci\u00e9t\u00e9, ses coll\u00e8gues ou tout tiers en affaire avec la dite soci\u00e9t\u00e9. Il ne doit pas non plus divulguer des informations priv\u00e9es sur ses coll\u00e8gues et ne doit \u00ab cyberharceler \u00bb personne.<\/li><li>Ne doit pas partager sur les r\u00e9seaux sociaux les informations confidentielles li\u00e9es \u00e0 son entreprise (secret de fabrication, liste de clients, etc.) L\u2019appartenance \u00e0 des groupes pr\u00e9judiciables aux int\u00e9r\u00eats de son employeur est \u00e9galement punissable.<\/li><\/ul><p>Ne doit pas passer un temps excessif sur les r\u00e9seaux sociaux ce qui pourrait nuire \u00e0 sa productivit\u00e9.<br \/><br \/>3. R\u00e8glement interne et sanctions<br \/><br \/>L\u2019employeur est tout \u00e0 fait en droit de pr\u00e9ciser l\u2019utilisation des r\u00e9seaux sociaux dans son r\u00e8glement interne. Il peut ainsi:<\/p><ul><li>Autoriser leur utilisation, voire la favoriser.<\/li><li>En interdire purement et simplement l\u2019utilisation.<\/li><li>Bloquer leur acc\u00e8s informatiquement.<\/li><\/ul><p>Quelle que soit l\u2019option choisie, celle-ci doit \u00eatre pr\u00e9cis\u00e9e par \u00e9crit par l\u2019employeur de m\u00eame que les sanctions en cas de non-respect.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>In view of the extent of social networks and their easy accessibility, employers are strongly advised to regulate their use by their employees.
